CNN —Federal Judge Aileen Cannon on Tuesday rejected special counsel Jack Smith’s request for a gag order against Donald Trump in the classified documents case, saying that prosecutors’ efforts to confer with the defendant was “wholly lacking in substance and professional courtesy.”In a brief order, Cannon slammed prosecutors for not following the court’s rules by failing to meaningfully confer with Trump’s defense lawyers about a potential gag order before making the request. Prosecutors can ask for a gag order again, Cannon said, once they give “sufficient time” to Trump’s defense team to read the motion and discuss it with prosecutors. Trump’s campaign, for instance, sent a fundraising email on Tuesday that claimed FBI agents were “locked and loaded” and that he “nearly escaped death” at Mar-a-Lago. The same standard FBI policy was used in the searches of President Joe Biden’s homes and offices in a separate classified documents investigation. In a blistering court filing late on Memorial Day, attorneys for Trump said that the gag order request was an “extraordinary, unprecedented, and unconstitutional censorship application” to target Trump’s speech as he runs for president.

CNN —Special counsel’s office prosecutors on Friday asked a federal judge in Florida to place a gag order on Donald Trump that would limit his ability to comment about law enforcement that searched his Mar-a-Lago resort. The same standard FBI policy was used in the searches of President Joe Biden’s homes and offices in a separate classified documents investigation. The prosecutors say the gag order is needed to protect the integrity of the criminal case and law enforcement officers associated with it. Prosecutors noted that Trump has been amplifying accusations about the FBI in the search on his Truth Social account Friday. Federal prosecutors say that he owned and operated Incognito Market, a dark web drug market selling heroin, cocaine, oxycodone, and other illicit substances. Part of the reason for those modest hopes was the fact that the defense case would not include testimony by the defendant. Later, the charging conference to agree on jury instructions showed how daunting the law is that Trump faces. All of that is bad news not just for Costello, whose clash with Merchan won Trump’s praise outside the courtroom Monday, but also for the defense. Because Costello was one of Trump’s only witnesses, there is also the risk that he — and the jury’s reaction to his poor attitude — will taint the defense case overall. There was little the defense could do about the law in the charging conference beyond their usual able argument.

CNN —Months before Donald Trump was indicted for mishandling classified documents, a federal judge said that investigators had “strong evidence” that the former president “intended” to hide classified documents at his Mar-a-Lago resort, according to newly released court documents. Judge Beryl Howell cited, among other things, the discovery of additional classified documents found at Mar-a-Lago months after the FBI’s search of the property in the summer of 2022. The ruling was among hundreds of pages of previously sealed filings that were publicly docketed Tuesday in the criminal classified documents case against Trump. Nauta has been charged alongside Trump and Mar-a-Lago property manager Carlos De Oliveira in the case, facing charges of mishandling sensitive or classified materials and obstruction. The case against Trump, brought last summer, is currently in front of Judge Aileen Cannon in Fort Pierce, Florida.

The man who might be the most significant defense witness for former President Donald Trump — and the last witness in his New York criminal hush money trial — resumes testimony Tuesday, a day after a judge ripped him for disrespectful conduct on the witness stand. The witness, criminal defense lawyer Robert Costello, was sharply warned Monday afternoon by Judge Juan Merchan for glaring at the judge and muttering in disdain when Merchan upheld objections from prosecutors. "I'm putting you on notice that your conduct is contemptuous now," Merchan told Costello, after clearing the courtroom of most of the public and press when he had had enough of the former federal prosecutor's antics. "If you stare me down one more time, I will remove you from the stand," Merchan warned, according to a transcript of the verbal beatdown. Cohen has said he paid Daniels to keep her quiet about a one-off sexual tryst with Trump in 2006 to keep her from damaging his chances in the 2016 presidential election.

Binance, a major crypto exchange, told Business Insider that it has developed an algorithm to spot fake crypto addresses — used in so-called "address poisoning" scams. According to Binance, the company's algorithm is detecting some 300,000 fake addresses every week, mostly on Ethereum and Bitcoin networks.
